These Subscription Terms and Conditions (“Terms”) govern the use of AYKA’s subscription services for Experts (Doctors, Nurses, and other Healthcare Staff) and Establishments (Clinics and Hospitals). By subscribing to any AYKA services, you agree to comply with these Terms.
- DEFINITIONS:
- “Expert” refers to doctors, nurses, and other healthcare professionals registered on AYKA’s platform.
- “Establishment” refers to clinics, hospitals, and other healthcare facilities.
- “AYKA” refers to the AYKA platform and its services.
- “Subscription Plan” refers to the selected plan under which Experts or Establishments access AYKA’s services.
- “Third-Party Companies” refer to external organizations posting job listings or offering healthcare-related services through AYKA.
- Subscription Plans & Fees:
- Expert Subscription Plans
Experts can choose between free and paid subscription plans based on their needs:
- Expert Free Subscription Plan
- No upfront subscription charges.
- AYKA charges a 50% fee on each sale (consultation, home visit, or service booking).
- Expert Paid Subscription Plan
- Requires an upfront subscription fee (pricing available on AYKA’s platform).
- AYKA charges a 20% fee on each sale instead of 50%.
- Additional benefits such as increased visibility, priority listing, and marketing support.
- Career Subscription Plan
- For Experts seeking job opportunities.
- AYKA will list the Expert’s profile in the Career Section and share job openings available from Third-Party Companies.
- Placement time commission will or may be charged on basis job category.
- Establishment Subscription Plans
Establishments subscribing to AYKA services can benefit from:
- Establishment Paid Subscription Plan
- Requires an upfront subscription fee (pricing available on AYKA’s platform).
- AYKA charges a 20% fee on each online booking made through the platform.
- Increased patient reach, clinic management tools, and integrated services such as insurance and lab testing support.
- SUBSCRIPTION FEES & MODIFICATIONS:
- AYKA reserves the right to modify, add, or remove services, pricing, and fees at any time. Any changes will be updated on AYKA’s platform.
- Subscription fees are non-refundable and non-cancellable once paid.
- Pricing for all subscription plans will be available on AYKA’s website and mobile application.
- PAYMENT & COMMISSION STRUCTURE:
- Experts and Establishments agree to AYKA’s commission-based model as outlined in the respective plans.
- All payments and commissions will be processed through AYKA’s integrated payment system.
- Any disputes regarding fees must be reported within 7 days of the transaction.
- NON-CANCELLATION & NO REFUND POLICY:
- All subscription payments are final. Once an Expert or Establishment subscribes, they cannot cancel their plan before the term ends.
- No refunds will be issued for unused portions of a subscription, change of mind, or partial usage.
- If AYKA discontinues a plan, affected subscribers may receive a pro-rated refund or alternative service at AYKA’s discretion.
- SERVICE AVAILABILITY & MODIFICATIONS:
- AYKA may modify, suspend, or discontinue any service at any time due to business needs or legal requirements.
- AYKA does not guarantee indefinite availability of any subscription plan.
- Users will be notified of significant changes in service offerings via email or platform announcements.
- RESPONSIBILITIES OF EXPERTS & ESTABLISHMENTS:
- Experts and Establishments must provide accurate and up-to-date information on AYKA’s platform.
- Misrepresentation of qualifications, services, or pricing may result in account suspension or termination.
- Experts must adhere to medical ethics and legal compliance while offering services through AYKA.
- THIRD-PARTY JOB LISTINGS & CAREER PLAN:
- The Career Subscription Plan provides Experts with access to third-party job listings shared by AYKA.
- AYKA does not guarantee job placement and is not responsible for hiring decisions made by third-party companies.
- Career Subscription fees are one-time charges and non-refundable.
- TERMINATION & ACCOUNT SUSPENSION:
AYKA reserves the right to suspend or terminate any subscription in the following cases:
- Violation of these Terms.
- Fraudulent activity or misrepresentation.
- Non-payment of applicable fees.
- LIMITATION OF LIABILITY:
- AYKA is a facilitator of healthcare services and does not take responsibility for the outcome of any consultation, medical service, or job placement.
- AYKA is not liable for any loss, damages, or disputes arising from interactions between Experts, Establishments, and patients.
- GOVERNING LAW & DISPUTE RESOLUTION:
- These Terms are governed by the laws of Saharanpur, Uttar Pradesh, India.
- Any disputes shall be resolved through negotiation, failing which legal proceedings may be initiated in the relevant courts.
